The following terms and conditions represent an agreement between you (the Player) and the Casino (Black Diamond Casino). The conditions provided govern the use of the Black Diamond Website and Online Casino. In accepting membership and playing the games in real money or fun mode, you agree to acknowledge, abide by, and adhere to any and all conditions set forth by the Casino and stated herein.

Eligibility

Black Diamond Casino offers no assurance regarding eligibility and/or legal right to participate or play in the Casino. Further, the Casino reserves the right to deny membership or suspend existing membership privileges for any reason deemed applicable, at the Casino's discretion.

• It is the explicit responsibility of the Player to be aware of and comply with the laws of his or her jurisdiction pertaining to gambling. Before placing real money wagers, it is up to the player to determine eligibility of participation and legality of said action, according to the laws of his location. The Casino bears no responsibility for restricted access of the website and casino, and provides no legal counsel for any player in the event of legal ramifications that result from play or attempted play. Consequently, individuals residing in Israel are expressly prohibitied from playing at Black Diamond Casino.

• In compliance with clearly defined legal restrictions, no player under the age of 18 is permitted to play at Black Diamond Casino. The Casino strictly adheres to this policy, and reserves the right to request proof of age at any time.
  

• Employees of Black Diamond Casino and members of their immediate families are prohibited from playing the games for real money, unless prior consent from casino management has been obtained. This restriction also applies to any and all licensees, distributors, wholesalers, subsideries, advertisers, and other agencies of promotion for Black Diamond Casino.
  

• By accepting the terms of membership laid out by the Casino, the player agrees to comply with all conditions set forth. The Casino reserves the right to cancel membership without notice and withhold play and/or payment should any party or action be deemed fraudulent by the casino. Unacceptable use of the Black Diamond Website and Casino that can result in account closure and/or confiscation of disqualified winnings include, but are not limited to the following:

1. False, misleading, or incorrect registration/account information. This extends to include information provided with regard to financial transactions, as all information supplied when depositing must match that of the account holder.

2. Multiple accounts. Players are allowed only one (1) active account. Additionally, no person other than the account holder is permitted to play either for fun or real money wagering on this account. Passwords and all account information should be kept secure and private at all times. It is the sole responsibility of the account holder to ensure and enforce this provision.

3. Lack of compliance to legal restrictions including underage gambling and participation by players residing in prohibited localities.

4. Any form of gameplay deemed to be fraudulent. The casino strictly prohibits the use of automated software or any other form of influence intended to manipulate game play and/or cause loss of revenue to the casino.

5. Deliberate "chargebacks" on monies deposited at Black Diamond Casino.

6. Attempts to defraud the Casino, by any means.

• In the event of account closure, any monetary amount remaining in the Player's balance that is not bound by wager requirements will be returned to the Player by check or credit card refund, barring those instances where fraud, abuse, or illegal financial transaction is suspected. The Casino reserves the right to disqualify and withold any winnings deemed attibutable to these occurrences.

• Further, players that do not access their casino account for a period of six months or more risk account closure due to inactivity, and may forfeit any or all monies remaining in their balance. Should a player request a withdrawal of funds after 180 days of inactivity, the casino will examine the request but reserves the right to invoke the standard six month rule.

GENERAL USAGE

The games at Black Diamond Casino are provided for entertainment purposes. Access and use of the casino and/or website for any other purpose is forbidden and all use is subject to compliance with set terms and conditions.

• The Player understands the games may be played for free or real money wagers, and accepts the responsibility of any risk therein. Real money wagers are not required, and players who choose to play for money do so at their own discretion, with the understanding there is the risk of loss of money.

• By placing real money bets, the Player acknowledges that doing so is legally permitted according to the laws of his given jurisdiction or locality. It is the sole responsibilty of the player to be aware of and comply with the legality of play.

• The Player recognizes that the games provided by Black Diamond Casino are for entertainment purposes and does not find them to be offensive, unfair, indecent, or otherwise objectionable.

• They player assumes responsibility for taxes on prizes and winnings from the casino.

• In concurrence with Gaming regulations, the Casino reserves the right to request documents from the Player for identity verification and/or to facillitate secure and accurate financial transactions. Required documentation may include photo ID, proof of address, copies of credit cards, and specific financial forms.

• All Player information is kept confidential and private. The casino will not provide player information to any third party for purposes of solicitation or distribution. The Player does however, agree to participate in promotional or advertising material upon acceptance of winnings or prizes deemed relevant, without additional compensation to the player. Black Diamond Casino reserves the right to publish the accordant details of said wins, and will publish only the first name and last name initial of the Player.

• Any attempt to cheat or defraud the Casino, either by submission of false information or by any means of fraudulent game play will result in the Casino taking appropriate measures. Criminal activities risk the perpetrator being reported to the pertinent legal authorities.

• Libelous statements, false accusations, and/or any other means that attempt to malign the name and reputation of the Casino will result in the use of every possible avenue available to the casino for legal recourse. Further, any player that attempts to defraud, cheat, or defame the casino with false information or injurous statements risks legal prosecution for damages.

• Affiliated organizations and personnel are not responsible for costs, expenses, and damages and/or liabilities that arise from action, legal or otherwise, taken by or against the player, including but not confined to any question of legality that arises for online wagering within the player's given locality, territory, country or jurisdiction.

• Use of the Casino and Website - The Player acknowleges and agrees that the Casino and it's employees, officers, directors, licensees, distributors, wholesalers, subsideries, advertisers, media partners and all other affiliated agents are not responsible for expenses, liabilities or damages resulting from the following:

  - Use of Casino and/or website
  - Use of casino/website server
  - Use of any casino or website materials
  - Player activity and use of casino games
  - Player's acceptance of prizes or winnings from the casino

• The Black Diamond trade name and all other associated material including terms, text, images, and related concepts with regard to the Casino and Website is the express property of the Casino. The player has no rights to the aforementioned casino product, and should these materials be obtained either physically or electronically and altered or damaged in any way they will be become null and invalid.

• Submissions for prize claims automatically become the property of the Casino and are non-refundable. The Casino bears no responsibility or consequence for events that result in lost, damaged, late, incomplete, or otherwise altered claims or prize entries.

• Player initiated disputes require that the complaint be submitted within 14 days of the alleged occurrence. Complaints rendered beyond the required time frame may be considered, however the casino reserves the right to enforce the standard rule and thereby is not required to address, and may reject any complaint made after 14 days.
  

GAMEPLAY

• The Casino reserves the right to change or remove any game or promotion with or without notice.

• Results of any inconsistency will be determined by that of the Casino server software.

• Progressive Jackpot wins are paid in US dollar amounts and are determined by the amount given at the time of the win.

• The maximum amount of withdrawal per player, per week is $5,000. Should the amount of winnings exceed the maximum monthly withdrawal permitted, $5,000 per week may be withdrawn with the remainder returned to the player's balance. Additional amounts of up to $10,000 may then be withdrawn the following month and each month thereafter until such time the full amount of available and desired withdrawal amount has been achieved. The maximum monthly withdrawal limit does not apply to the Progressive Jackpot wins. This will be paid in one lump sum amount.

PROMOTIONAL

Bonuses and promotional incentives are offered by the Casino as a reward to Players and in effort to enhance and/or extend Player entertainment. As bonus and promotional rewards are given in the spirit of fair play, any abuse or misuse of bonus monies may result in the exclusion of bonus offers for the player.

• Promotions and bonuses are valid for 48 hours, unless otherwise stated.

• All bonuses are optional. If a bonus has been added to the account of a player who does not wish to accept bonus monies, the player must advise the Casino and request the removal of the bonus before any play has occured to avoid wager requirements and restrictions.

• Unless otherwise stated, bonus monies must be wagered fifthteen times (15x) the amount of the bonus and deposit combined. These wagering requirements must be fullfilled before the player may withdraw any amount from his/her balance.

• Table games and card games are excluded from slot bonus game play unless and until the required play through has been met. Should any bonus be wagered on restricted games before wager requirements have been fully met, the Casino reserves the right to withhold all monies that exceed the player's original deposit.

• All other games carry various contributory percentages toward the fullfillment of wager requirements.

• With regard to free money bonuses, 100% slots play is required. Winnings from this bonus will be disregarded if play on any other game is found to have been undertaken.

• Bonus abuse of any kind is strictly prohibited and will result in the removal of said bonus and any winnings achieved therein. Bonus abuse extends to include, but is not limited to: cashing out from bonus play before fullfilling wager requirements or any other promotional requirement set for given bonus and/or play on restricted. games. Additionally, the casino reserves the right to remove bonus or winnings from bonuses in the event of cancellation of payment by player and/or payment service.

• Absence of activity for a period of 4 weeks or more will result in the removal of any bonus balance acquired.

Final Agreement

The Player agrees to acknowlege, accept, and comply with all provisions set by the Casino Terms & Conditions. Should these terms be deemed unsatisfactory, the Player should not enter into the agreement and as such, refrain from registration and use of Black Diamond Website and Casino.

The Casino reserves the right to alter and/or update the terms and condtions when necessary. It is recommended that the Player review these Terms and Conditions periodically for updates and/or changes in accordance with the responsibility to acknowledge and comply with current Casino policy.
